In Cardella v. Castle Rock, Andrew Nathan and Marni Nathan Kloster successfully argued that documents relating to a criminal investigation, which involved pending criminal prosecutions, could not be disclosed to private individuals or the ACLU under the Colorado Criminal Justice Records Act. The plaintiffs were seeking records relating to a discharge of a firearm that occurred during a felony arrest in 2013. In an area with limited precedent, the firm was able to ensure that the government’s interest in effective criminal prosecution outweighed the private interests of the ACLU and their clients.
