In Carani v. Meisner, Bernard Woessner successfully defended members of the Rifle Police and Public Works departments in U.S. District Court against claims of false arrest, false imprisonment and defamation, obtaining a summary judgment and an attorney fees award in excess of $200,000.00. On appeal, 521 Fed.Appx 640 (10th Cir. 2013), Bernard successfully argued before the Tenth Circuit Court of Appeals that law enforcement officers are not required to learn and test the veracity of all facts prior to arrest, and instead may rely upon circumstances known to them after a reasonable investigation when determining probable cause to make an arrest. This decision by the Tenth Circuit makes an important distinction from prior case law where law enforcement officers discovered, but ignored, the existence of potentially exculpatory evidence.
