In 2013, Bernard Woessner successfully represented the City of Central in Ballowe v City of Black Hawk et al., Gilpin County District Court, concerning a property that had been used as a roadway, but that the Plaintiff claimed was unencumbered by the prescriptive use. Recognizing that the City of Central made significant efforts to maintain the roadway, the Court held that the roadway was established by prescriptive easement under § 43-2-201(1)(c), C.R.S.
